Best Alternative to Negotiated Agreement

Your walkaway option. The stronger your BATNA, the more leverage you have. Never accept a deal worse than your best alternative.

ZOPA

Zone of Possible Agreement

The overlap between what each party is willing to accept. If no overlap exists, there is no deal to be made. Negotiation skill expands the ZOPA.

Weingarten Rights

Weingarten rights apply ONLY in unionized workplaces. Non-union employees do NOT have Weingarten rights.

Weingarten ONLY in Union Workplaces

Weingarten rights grant employees the right to union representation during investigatory interviews that could result in discipline. Non-union employees do NOT have Weingarten rights. The exam will present scenarios in non-union settings to see if you apply it incorrectly.

The Employee Must REQUEST Representation

Weingarten rights are not automatic. The employer is not required to inform the employee of the right or offer a representative. The employee must affirmatively ask for union representation. If they do not ask, the interview proceeds.

The Union Rep Confers but Cannot Answer

The union representative can speak privately with the employee during the interview and can clarify questions. However, the representative cannot answer questions on the employee's behalf. The employee must respond to the employer's questions directly.

Your best alternative to a negotiated agreement determines your negotiating power. A strong BATNA means you can walk away.

The Right to a Lawyer

In a criminal case, you have the right to an attorney during questioning. Weingarten is the workplace equivalent, but only if you are in the union "court system." Non-union employees are on their own.

You Must Ask

Unlike Miranda rights, nobody is required to tell you about Weingarten. You have to know your rights and request representation yourself. If you forget to ask, the interview continues without a rep.

The Rep's Role

Your union representative can whisper advice in your ear and ask for clarification, but they cannot take the witness stand for you. You still answer the questions. The rep is a counselor, not a spokesperson.
